Bitácora Terms and Conditions
Version 1.1 · Effective from October 18, 2026
These terms are the agreement between you and A.SMITH GROUP, EIRL for using Bitácora. We wrote them so you can understand them without being a lawyer. If anything is unclear, write to us at hola@bitacora.live before you accept.
The essentials (this summary does not replace the full text):
- What you create in Bitácora is yours. We do not use it to train artificial intelligence.
- Bitácora does not sell artificial intelligence: the AI that works on your projects is the one you connect, and it is also governed by its provider’s terms. To get you started, we may give you some runs with ours.
- Nothing changes in your screens unless you authorize it, and you review what the AI produces before you hand it off.
- Payments are collected by Lemon Squeezy. As a general rule they are not refunded, but we respect the rights the law gives you (for example, 14 days to withdraw if you are a consumer in the European Union, or 7 days if you are in Brazil).
- You can take everything that is yours whenever you want, and cancel from the app.
1. Who we are
Bitácora is a service of A.SMITH GROUP, EIRL (“we”), a single-owner limited liability company (EIRL) incorporated in the Dominican Republic, with tax ID (RNC) 132654226 and registered address at Calle Miguel A. Piantini, Ed. 73, #101, San Carlos, Distrito Nacional, Dominican Republic.
- Email: hola@bitacora.live
- Phone: +1 (829) 478-2023
When we say “you”, we mean the person who creates an account, or the company on whose behalf they create it.
2. What you accept and how
You accept these terms when you create your account by ticking the corresponding box. Your electronic acceptance has the same value as a signature. We keep a record of which version you accepted and when, and you can always read the current version at bitacora.live/terms. After each purchase we email you the confirmation and a link to the version of these terms you accepted, so you can keep it.
The following are part of this agreement:
- The Privacy Policy, which explains what data we process and how.
- The Affiliate Program Terms, only if you take part in the program.
- The Data Processing Agreement, for the data about your clients that you keep in Bitácora (section 9).
- The pricing page (bitacora.live/pricing), for what it says about prices and what each plan includes.
If you accept on behalf of a company, you confirm that you can bind it, and “you” includes that company.
3. Who can use Bitácora
- You must be at least 16 years old.
- If you are in Brazil, you must be at least 18 years old.
- If you are 16 or 17, you can only use the free plan and you need permission from your parent or guardian. By creating the account you declare that you have it.
- To buy a paid plan or join the affiliate program you must be of legal age (18, or the age of majority in your country if it is higher).
- If we learn that an account belongs to someone under 16, we close it and delete their data.
- You may not use Bitácora if you are in a country or territory subject to comprehensive sanctions by the United States, the European Union or the United Nations (currently including Cuba, Iran, North Korea and the Crimea, Donetsk and Luhansk regions), or if you or your company appear on a list of sanctioned persons. Nor may you use it to provide services to those persons or territories.
4. What Bitácora is
Bitácora is a tool for designing interfaces. You go through your screens on a canvas, dictate or type the changes you want (“logs”), authorize them, and the artificial intelligence tool you connect runs them on the project files. Then you can share the prototype with your client in a portal, work as a team, and hand off the result to developers.
Three things are worth being clear about:
- Nothing changes without your permission. Dictating changes nothing. A screen changes when you authorize a run, or when the AI tool you connected acts with the permission you gave it.
- Bitácora produces prototypes. The screens are real HTML and CSS and are meant to show, review and hand off, but they are not a production-ready application. Before using them in a real product, review them as you would any code.
- The service changes. We add features and change others. If a change harms you significantly, we tell you in advance (section 17).
Features marked as new, “in testing” or “beta” may fail more often, change or be withdrawn, and we offer them as they are.
5. Your account
- Your account is personal. The links and codes we send you to sign in, your password if you use one, and the permissions you give to an AI tool are yours: do not share them. Whoever has them gets in as you.
- The information you give us must be true and up to date.
- You are responsible for what happens in your account, unless it is caused by a failure on our side. If you think someone got in without permission, tell us right away and close your open sessions from Settings.
- We send service and security notices to your account email. Our emails and in-app notices count as written communications.
6. The artificial intelligence is yours
Bitácora does not sell artificial intelligence, and does not charge you per log or per run (except for the courtesy runs in point 8, which are a gift). For the AI to work, you connect the AI tool you already use (for example Claude, ChatGPT or Cursor) through our MCP server, or you add your own API key from an AI provider.
This leads to the following rules:
- You choose the provider. When you connect an AI tool, the content that tool reads and writes in your projects goes through its provider, under its terms and privacy policy. Follow its terms. We do not control what that provider does with the content.
- You give the permissions. When you connect a tool, you give it permission to read your projects (all of them or just one) and, if you choose, to change them. You can review and remove that permission at any time in Settings. Whatever the tool does with that permission (creating, moving, rewriting or deleting screens) counts as done by you.
- Your API key. If you add your key, we store it encrypted, never show it in full, and only use it to send that provider the content of the runs that you, or the people you lend it to in a project, carry out. Usage is paid by your account with the provider.
- If your provider fails, runs out of credit, suspends you or changes its terms, running with AI stops working in Bitácora. We are not responsible for that.
- AI makes mistakes. It may misunderstand a log, change something you did not ask for, or produce something similar to other people’s work. Always review the result before showing or handing it off. We keep the history of every screen and you can undo a whole run or a single screen, but the decision about what you hand off is yours.
- What the AI produces in your projects is yours, to the extent allowed by law and by your provider’s terms. We claim no rights over it. Keep in mind that, in many countries, content generated by AI without human creative input may not be protected by copyright.
- Confirm each run. You can ask Bitácora to request your permission before every run, including the ones your tool requests through the connector. If you do not give it in time, the run does not happen.
- Courtesy runs. So you can try Bitácora before connecting your AI, we may give you some runs with our own AI account (currently Claude, by Anthropic). In those runs, Bitácora sends the content of the run to the provider and pays for it. They are a gift: they have no cash value, cannot be exchanged or transferred, and we decide how many we give, to whom and until when, with no obligation to keep offering them. Everything else in this section still applies: review the result, and what is produced in your projects is yours.
7. What you create is yours
Your projects, screens, sketches, logs, voice notes, documents, images and everything you upload or create in Bitácora (“your content”) remain yours or your client’s. We acquire no ownership rights over them.
To provide the service we need your permission for a few things. You give us a free, non-exclusive, worldwide license limited to these uses:
- storing your content and making backups;
- showing it to you, to the people on your team and to the people you share it with (portal, deliveries, links);
- generating captures, thumbnails, versions and previews;
- converting it into the formats you ask for (for example, a download ZIP);
- transcribing your voice notes and sending your content to the AI tool you connect (or, in a courtesy run, to our AI provider), when you authorize a run or when that tool asks for it with your permission.
This license lasts while your content is in Bitácora and ends when you delete it, except in backups, which disappear within 35 days at most. We do not use your content to train artificial intelligence models, or for advertising, and we do not sell it. We do not show it as an example on our website without your express permission.
You guarantee that you have the right to use what you upload (images, text, trademarks, fonts, other people’s data) and to give us this license.
8. Acceptable use
You may not use Bitácora to:
- Deceive anyone with a prototype. It is forbidden to create or share pages that imitate a real website, app or brand so that someone believes it is the genuine one; fake sign-in pages; forms that collect passwords, card details or identity data from real people; and any form of phishing or fraud. A prototype for a real client with their permission is allowed; passing it off as the real site to the public is not.
- Publish or share content that is illegal, infringes other people’s rights (copyright, trademark, image, privacy), incites hatred or violence, is sexual and involves minors or lacks consent, or harasses someone.
- Distribute malware, code that harms the device of whoever opens a prototype, cryptocurrency mining or hidden redirects.
- Use Bitácora as general file hosting, to send bulk email, or to serve content unrelated to designing a project.
- Try to access other people’s accounts, projects or systems, test the security of the service without our written permission, bypass usage limits or signed links, or reverse engineer the software.
- Extract data or content automatically (scraping) outside the MCP connector and the channels we document. Automating your own work with the connector is allowed: that is what it is for.
- Resell access to Bitácora or open accounts for third parties as if it were your product.
- Impersonate another person or company, or suggest you are affiliated with us when you are not.
- Upload images or data of minors without the authorization of their parents or guardians.
- Commit any crime, including those defined in Dominican Republic Law 53-07 on high-technology crimes or in the laws of your country.
Prototypes and portals are not indexed by search engines, but anyone with the link can see them. Share them with care.
9. Your clients, your team and the people you invite
Projects belong to the studio that creates them. If you invite someone to your project, the project is still yours: you can change their role or remove their access whenever you want. What that person did (logs, sketches, comments) stays in the project under their name. If you work on someone else’s project, the person who created it decides about it.
What the people on your team see. Members of a team see the name, email, photo and activity of the other members in the team’s projects.
Your clients’ data. In Bitácora you can keep companies and people in My clients (including by importing them from your phone or from a file), share prototypes with them in a portal, and see who opened them and what they commented. This is personal data of other people, and responsibilities are split like this:
- You decide what data about your clients you put into Bitácora and for what purpose. You are the controller of that data: you need a legal basis to process it and you must inform those people that you use Bitácora and that you will see their visits and comments.
- We process it on your behalf, only to provide the service (sending access links, serving the portal, recording visits, notifying you of comments), with security measures and a duty of confidentiality, and never for our own purposes. The Data Processing Agreement, at bitacora.live/data-processing, is part of these terms and you accept it with them.
- When you invite someone, we write to them on your behalf. You declare that you have a reason to do so.
Bitácora charges your clients nothing. If you record the amount of a project or what you have been paid, it is your private record. We do not issue invoices or collect payments from your clients on your behalf. We only use those amounts added up with other people’s, in a way that identifies no one, as market data (the Privacy Policy explains this).
What your clients write in the portal is the responsibility of whoever writes it and yours, as you gave them access.
Deliveries to developers. If you send a delivery with developer mode and downloads turned on, you authorize the recipient to download it and to connect their own AI tool to read it. What that person and their AI provider do with the content is outside our control. You can remove access by taking the person off the delivery, turning off developer mode or hiding the delivery.
10. Plans and prices
- There is a free plan with limits and several paid plans. What each plan includes (projects, logs, seats, storage, downloads, branding in the portal) and its price are on the pricing page, which is what counts. It may change with the notice in section 13.
- Prices are in US dollars. Before you pay you see the final price including your country’s taxes. If you pay with a card issued in Brazil, your bank may also charge IOF tax and currency conversion, which depend neither on us nor on Lemon Squeezy.
- Paid plans are paid in advance each month or each year. Paying yearly costs less than twelve separate months.
- When you reach a plan limit, new activity stops (creating or importing projects, running, uploading files) until the next period or until you upgrade. What you already have is not deleted.
- There are also reasonable technical limits on size and frequency that protect the service for everyone. They may be adjusted and are shown in the app when you reach them.
11. Renewal and how to cancel
- Paid plans renew automatically at the end of each month or year, with the same payment method and at the current price, until you cancel. Before you pay we show you the price, how often you are charged, the date of the first charge and how to cancel, and we ask you to accept the renewal.
- Welcome discount. If you subscribe with the welcome discount from an affiliate link, only the first month is discounted; from the second month on, the plan’s normal price is charged.
- Yearly plan. We email you at least 30 days before each yearly renewal with the amount, the date and how to cancel.
- Canceling is as easy as subscribing: from Settings, in the app, without writing or calling us. Cancellation takes effect at the end of the paid period; until then you keep using your plan and can undo it.
- Canceling deletes nothing: your account moves to the free plan with its limits.
12. Who charges you
Payments are processed by Lemon Squeezy (Sold through Link, LLC, part of the Stripe group), or the entity that replaces it, acting as reseller and merchant of record for Bitácora subscriptions and add-ons. In practice:
- Lemon Squeezy charges you, issues the invoice or receipt and pays your country’s taxes. Its name appears on your statement.
- Your card details are handled by Lemon Squeezy. We never see or store them.
- Your receipts and payment method are managed from Lemon Squeezy’s customer portal, which you reach from Settings.
- When you pay, you also accept its buyer terms (lemonsqueezy.com/buyer-terms), which govern the charge. We provide the service and are responsible to you for it.
- Before opening a dispute with your bank, write to us: it is almost always resolved sooner.
If we change payment processor, we will tell you in advance and you will not have to subscribe again.
13. Price and plan changes
- We may change prices. If your plan’s price changes, we email you at least 30 days in advance and the new price applies at the next renewal. If it does not suit you, cancel before that date.
- You can upgrade whenever you want. Downgrading takes effect at the end of the paid period, without proration, and you can undo it until then. If the plan you move to includes fewer seats or collaborative projects, we tell you before you confirm.
14. Collaboration passes and seats
Working with more people on a project is paid with a collaboration pass, for the months you choose and with the seats you need, or with the seats your plan includes.
- The pass is a one-time payment in advance. It runs from the moment you buy it until it expires, whether or not you use the project, and whether or not it is archived.
- Seats are slots, not people. If someone leaves, another person takes their place without paying again. Seats included in a plan do not carry over from one month to the next.
- If there are not enough seats (because the pass expires, because you downgrade, or because your plan is no longer paid), the people who do not fit stay in the project, with their role and everything they did, but wait at the door without access until there is a seat again. You choose who keeps access; if you do not choose, the longest-standing members keep it. We let you know before a pass expires.
- A purchased pass requires a paid plan in good standing: if your plan stops being paid, the pass is frozen until it is paid again.
- Your client in the portal does not take up a seat.
15. Refunds
General rule: payments in Bitácora (monthly and yearly plans, passes, seats, developer mode and extra storage) are not refunded, including when you cancel or downgrade: what you paid lasts until the end of its period. If you think your case is special, write to us at hola@bitacora.live and we will look into it.
This rule does not limit the rights the law gives you. In particular:
- If you are a consumer in the European Union, the European Economic Area, Switzerland or the United Kingdom, you have 14 days from the purchase to withdraw without giving a reason, using the “Withdraw from contract here” button in Settings or by writing to us (section 16). We refund what you paid within 14 days at most, using the same payment method. If you asked to start using the plan during that period, we deduct the part proportional to the time you used it.
- If you are in Brazil, you can change your mind within 7 days of buying a plan or an add-on, without giving a reason, using the “Withdraw from contract here” button in Settings, by writing to us at hola@bitacora.live, or through the same channel you used to buy. We immediately refund everything you paid, adjusted for inflation, using the same payment method, and ask your card issuer to cancel or reverse the charge (Brazilian Consumer Protection Code, art. 49, and Decree 7.962/2013). This applies to anyone buying from Brazil, whether or not they are a consumer.
- If you are a consumer in the Dominican Republic, you have 7 business days from the first charge of your first paid subscription to cancel it and get a refund of what you paid.
- If the service does not work as we offered it and we do not fix it within a reasonable time, or if we close your account without you having breached these terms, we refund the part you paid and could not use.
- Any other case in which the law of your country requires a refund.
You are a consumer if you use Bitácora for purposes outside your professional activity, for example to learn or for fun. If you use it to work for clients or for your company, you are not.
Refunds are processed by Lemon Squeezy, so they may take a few days to show in your account. Lemon Squeezy may also decide on a refund on its own, under its terms.
16. Withdrawal for consumers in Europe or if you are in Brazil
If you are a consumer and live in the European Union, the European Economic Area, Switzerland or the United Kingdom:
- You can withdraw from your contract (a plan, a yearly payment, a pass or another add-on) within 14 days of buying it, without giving a reason.
- To do so, use the “Withdraw from contract here” button in Settings › Plan, which is visible during those 14 days, and confirm with “Confirm withdrawal”. We immediately email you a receipt with the date and time. You can also write to us at hola@bitacora.live with your name, your account email and what you want to cancel, or use the model form below.
- When you buy, we ask whether you want to start using it right away. If you say yes and later withdraw, you only pay the part proportional to the time used.
- The right of withdrawal does not start again with each automatic renewal of the same plan.
If you are in Brazil, the “Withdraw from contract here” button is visible for 7 days after each purchase and refunds everything you paid, even if you have already started using the plan. We immediately email you to confirm we received your request.
Model withdrawal form (only if you want to use it):
To A.SMITH GROUP, EIRL, Calle Miguel A. Piantini, Ed. 73, #101, San Carlos, Distrito Nacional, Dominican Republic, hola@bitacora.live:
I hereby give notice that I withdraw from my contract for the following service: [plan or add-on], purchased on [date].
Name: [ ] · Account email: [ ] · Date: [ ]
17. Changes to the service
We may change Bitácora to improve it, for technical or security reasons, or to comply with the law. If a change significantly reduces what your paid plan includes, we email you at least 30 days in advance explaining the change, and you can cancel your plan at no cost; if you are a consumer, we also refund the part you paid and have not used.
If we ever decide to shut Bitácora down, we will give you at least 60 days’ notice so you can take your content, and we will refund the part you paid and have not used.
18. Availability and backups
We work to keep the service running at all times, but we cannot promise it will never fail. There will be maintenance downtime, which we announce when it is foreseeable, and there will be failures.
We make backups every night. They are how we recover from a disaster, not a service to give you back a specific version of something you deleted. For that you have the history of each screen, the project trash (30 days), undoing a run and the downloads. If your work is critical, download it regularly.
19. Taking your data and switching providers
We do not hold you back with your data.
- On any plan you can download everything in your space from Settings (Take your things): projects, screens, assets, logs, comments and your client portfolio, in HTML, CSS, images and readable text and JSON files, the same formats the tool works with.
- Some plans add downloads per screen or per project (see the pricing page).
- If you want to switch to another provider, you can do so whenever you want: there is no minimum notice and no charge for switching or for downloading your data. If you ask, we help you for 30 days and the service keeps working in the meantime.
- If we close your account, or if you close it and ask us for time to download, you will have at least 30 days to take your data. After that we delete it completely (backups disappear within 35 more days at most).
- Internal operating data of the service (technical logs, internal metrics), which is not your content, is not exported.
Our servers are in the United States. The Privacy Policy explains how we protect your data and what happens if an authority requests it.
20. Closing your account
If you close it. You can delete your account from Settings. When you do, your subscription is canceled, your sessions are closed and your AI tools’ permissions are removed. You have 14 days to change your mind: if you sign in again within that period, the deletion is canceled. After that, everything is deleted (your projects, clients, teams, portal and your place in other people’s projects), and we notify anyone who loses access to something of yours. Download your things first.
If we suspend or close it. We may limit, suspend or close an account, or remove or block a project or content, if:
- you breach these terms or the law;
- we receive a well-founded report about your content;
- there is a risk to the security of the service or of other people;
- a payment fails and is not resolved after we notify you;
- an authority or a court orders us to.
We act proportionately. Unless the case is serious or urgent, we warn you first and give you a chance to fix it. When we take one of these measures, we will email you what we did, from when and until when, for what reason (which part of these terms or of the law), whether it came from a report or from our own review, and how to ask for a person to review it. We will only leave out the reason when the law or an order from an authority prevents us from giving it.
If we block a project, its portal keeps showing a notice for 30 days and then stops being available. If we close your account without you having breached these terms, we refund the part you paid and have not used.
21. Reporting content and copyright
Anyone can tell us about content hosted on Bitácora (a prototype, a portal, an image) that they believe is illegal or against these terms, by writing to hola@bitacora.live with:
- the exact address (URL) of the content;
- why you believe it is illegal or breaches these terms;
- your name and email (unless it concerns child sexual abuse, which you can report anonymously);
- a statement that what you tell us is true to the best of your knowledge.
We confirm receipt, a person reviews it, and we tell you what we decided. We may block the content while we review it. Knowingly making a false report may make you liable.
If the content concerns Brazil, your report must identify the content (its URL), explain why you believe it is a crime or an unlawful act, and say who you are. We confirm receipt and, whether we remove it or keep it, we tell you and the person who published it, with the reason and how to ask for a review. We remove intimate images shared without permission and content that violates the rights of children and adolescents without waiting for a court order, as soon as the victim or their representative tells us. For harm to someone’s reputation, we act on a court order.
Copyright (DMCA, United States). If you hold a copyright, you can also send a notice to our designated agent: Copyright Agent, A.SMITH GROUP, EIRL, Calle Miguel A. Piantini, Ed. 73, #101, San Carlos, Distrito Nacional, Dominican Republic, +1 (829) 478-2023, hola@bitacora.live. The notice must include: your physical or electronic signature; the work you believe is infringed; the material you believe is infringing and its URL on Bitácora; your name, address, phone and email; a statement that you believe in good faith that the use is not authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on their behalf.
If we remove content of yours because of a copyright notice, we will tell you. If you believe it was a mistake, you can send us a counter-notice with: your signature; the material removed and where it was; a statement, under penalty of perjury, that you believe in good faith it was removed by mistake; and your name, address and phone, consenting to the jurisdiction of the federal court for your district or, if you live outside the United States, of any district where we may be found. We will pass it on to the person who complained and restore the material 10 to 14 business days later, unless that person tells us they have filed a lawsuit.
In appropriate cases, we close the accounts of repeat infringers.
For authorities in the European Union, the point of contact is hola@bitacora.live (in Spanish, English or French).
22. Third-party resources
- Photos from Pexels and Pixabay. You can search for them and insert them from Bitácora. They are used under their licenses (pexels.com/license and pixabay.com/service/license-summary): you can use and modify them in your prototypes, but not sell them as they are, use them as a trademark or logo, or suggest that a person or brand shown endorses your product. Neither Bitácora nor those platforms guarantee permissions from the people, brands or places that appear in the photos: check before any commercial use.
- Fonts, icons and libraries you use in your projects are governed by their own licenses. The fonts of Bitácora’s interface have their own license and are not licensed to your projects.
- Other companies’ trademarks. The names and logos of other companies shown in Bitácora or on our website (for example, of compatible AI tools) belong to their owners. We show them only to indicate compatibility; it does not mean we are associated with them or endorsed by them.
23. What is ours
Bitácora’s software, name, brand, design, interface and documentation are ours. While your account is in good standing, we give you a personal, non-exclusive and non-transferable right to use the service under these terms, and nothing more: you may not copy the product or use our brand without permission.
If you send us ideas or suggestions, we may use them to improve the product without owing you anything for them. This does not affect the ownership of your content.
24. Warranties and liability
We provide the service with care and in good faith, but as is and as available. We do not guarantee that it is error-free, always available, or that the results of the AI you connect are correct, original or suitable for what you need.
We are not liable for:
- what the AI tool you connect writes, changes or deletes in your projects with your permission;
- the failures or decisions of the AI provider you choose, of your connection or of third-party services;
- what the people you share a project, a portal or a delivery with do;
- lost profits, lost business or opportunities, or indirect damages.
Our total liability for everything related to the service is limited to the greater of these two amounts: what you paid us in the 12 months before the event giving rise to it, or 100 US dollars.
Nothing in this section limits our liability for willful misconduct or gross negligence, for death or personal injury, the rights the law gives you as a consumer (including the legal guarantee that the service works as offered), or any other liability that the law does not allow to be limited.
If you are a consumer in Brazil, the limits in this section do not apply to damages caused by failures of the service: we are liable under the Consumer Protection Code.
You are liable to us for damages and third-party claims caused by your content or by breaching these terms.
25. Changes to these terms
We may update these terms. If the change is minor (a correction, a clarification), we change the version and date at the top. If the change affects your rights, what you pay or how we treat your content, we notify you by email and in the app at least 30 days in advance, explaining what changes and why, and we ask you to accept the new version. If you do not agree, you can cancel your plan or close your account before it takes effect; if you are a consumer and the change harms you, we refund the part you paid and have not used.
Previous versions are available at bitacora.live/terms.
26. Governing law and complaints
- These terms are governed by the laws of the Dominican Republic.
- If you use Bitácora as a professional or a company, any dispute is settled before the courts of Santo Domingo, Distrito Nacional.
- If you are a consumer, you keep the protection of the laws of your country of residence that cannot be waived, and you can bring a claim before the courts where you live or before the relevant consumer authority (in the Dominican Republic, Pro Consumidor).
- If you are in Brazil, nothing in this section takes away the protection of the Consumer Protection Code, the Brazilian Civil Rights Framework for the Internet (Marco Civil) or the General Data Protection Law (LGPD). You can bring a claim before the courts of Brazil (if you are a consumer, those where you live) and before your state’s Procon. We reply within 5 days at most to complaints, questions and cancellation requests sent from Brazil.
- Before going to court, write to us at hola@bitacora.live: we confirm receipt of your complaint and reply within 10 business days at most. We try to resolve it within 30 days. This does not oblige you to anything and does not stop you from complaining through other channels.
- We do not use mandatory arbitration or class action waivers.
27. Other provisions
- Language. These terms are written in Spanish. If a translation exists and differs, the Spanish version prevails, unless the law of your country requires otherwise. If you are in Brazil, the Portuguese version prevails.
- If a clause is not valid, the rest remains in force, and we replace it with a valid one as close as possible.
- Assignment. We may assign this contract to another company that continues the service (for example, in a sale or reorganization), telling you in advance, without you losing any rights. You may not assign it without our permission.
- Not exercising a right at a given moment does not mean we waive it.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control (disasters, widespread internet or provider outages, acts of authorities).

Affiliate Program Terms
Version 1.1 · Effective from October 18, 2026
These terms apply if you take part in the Bitácora affiliate program. They complement the Terms and Conditions above, which also apply. You accept them by ticking the box in the application; we keep a record of the date and the version you accepted.
The essentials:
- You earn a fixed commission for each month paid by a person who arrived through your link: Essential $2, Professional $5, Studio $15, Agency $25, for 24 months from their first payment. Up to $600 per person, with no limit on the number of people.
- Each commission becomes available after 30 days and is paid out from $25. Lemon Squeezy pays you.
- You must always say that you earn a commission when you recommend Bitácora.
1. Who can take part
- People of legal age (18, or the age of majority in your country if it is higher) and companies, with a Bitácora account. A free account is enough.
- To get paid, you must be able to sign up as an affiliate with Lemon Squeezy and receive payments in a country it supports.
- You may not take part if you are in a sanctioned country or on a list of sanctioned persons (section 3 of the Terms).
2. The application
- Joining is free. We review every application by hand. We may accept or reject it without giving a reason; if we reject it, you can apply again after 60 days.
- If we accept you, we send you the link to join our program on Lemon Squeezy, which does its own review and has its own affiliate terms (lemonsqueezy.com/affiliate-terms), which you accept there. Without an approved Lemon Squeezy account we cannot pay you. Then you receive your Bitácora link.
3. Your link and who is attributed to you
- Your link is
app.bitacora.live/r/<your code>. When someone opens it, they land on bitacora.live, where we ask whether they accept cookies. If they accept and create a new Bitácora account within the following 60 days, that account is attributed to you. - If that person opened links from several affiliates, the last one they opened before creating the account counts.
- Once attributed, the account stays yours even if they pay months later. An account on the free plan does not generate a commission until it moves to a paid plan.
- There is no attribution if the account already existed, if the person rejected cookies or deleted them from their browser, or if the account is yours, belongs to a studio you own or are a member of, or to someone acting for you.
4. How much you earn
- For each paid month of a plan, according to the plan paid that month: Essential $2, Professional $5, Studio $15, Agency $25. These are fixed amounts in US dollars that do not depend on taxes or discounts: the month with the welcome discount also generates the full commission.
- For 24 months from each person’s first payment. If they stop paying, their commissions stop; if they come back within those 24 months, they count again, without the period restarting. At most, $600 per person (Agency for 24 months).
- Yearly payment: if the person pays for a whole year, it counts as twelve months and you receive the commissions for those twelve months at once, always within their 24 months (if they had already paid for 20 months, the yearly payment adds 4). If they renew for a second year, you receive the commissions for the months that remain.
- Plans only. Collaboration passes, seats, developer mode, extra storage and the free plan do not generate commissions.
- No limit on people. You can bring as many people as you want.
- Refunds: if a charge is refunded, disputed or canceled, its commission is canceled. If you had already been paid for it, we deduct it from your next commissions.
- If, through an error by us or by Lemon Squeezy, you receive more than these terms say, we will not claim it back, except in case of fraud.
- What the calculator on the website shows is only an estimate: what you earn depends on how many people you bring, which plan they choose and how long they pay.
5. How you get paid
- Lemon Squeezy pays you from its Affiliate Hub, in US dollars, by bank transfer or PayPal, on its schedule.
- Each commission becomes available 30 days after the charge that generates it. It is paid out when your available balance reaches $25; if it does not, it carries over to the next payout.
- Lemon Squeezy, your bank or PayPal may deduct their own fees and currency conversion.
- Taxes: you declare and pay the taxes on your commissions. Lemon Squeezy may ask you for a tax form (W-9 or W-8) and hold payouts until it has it.
- We may move the program to another payment provider or to our own tool with 30 days’ notice. What you have already earned is respected and paid.
- As to how and when you are paid, Lemon Squeezy’s terms also apply. As to how much you earn and how you may promote Bitácora, these terms prevail.
6. The welcome discount
- People who arrive through your link get 40% off the first month of any monthly paid plan if they create a new account and choose the plan within 2 hours of opening your link. It is applied on the checkout page, without typing any code.
- It does not apply to yearly plans, to upgrades, or to accounts that already had a paid plan. From the second month on, the normal price is charged.
- If you mention it, state all its conditions. Do not publish or share any discount code, and do not offer other discounts or free trials that do not exist.
- We may change or withdraw the discount with 30 days’ notice. It does not change what you have already earned.
7. How you may recommend Bitácora
Always say that you earn a commission. At the start of your content and next to every link, clearly and in your audience’s language. In video, say it or show it on screen, and also put it in the description. Also use each network’s paid partnership label where there is one. Valid examples:
- English: “Ad: I earn a commission if you subscribe to Bitácora through my link.”
- Spanish: “Publicidad: si te suscribes a Bitácora con mi enlace, recibo una comisión.”
- French (audience in France, “Publicité” or “Collaboration commerciale” is mandatory): “Collaboration commerciale : je touche une commission si tu t’abonnes à Bitácora avec mon lien.”
- Portuguese (audience in Brazil): “Publicidade: se você assinar a Bitácora pelo meu link, eu recebo uma comissão. #publi”
“Affiliate link” on its own is not enough.
If you target an audience in Brazil, use “Publicidade”, “#publi” or “#publicidade”, visible at first glance without having to open “see more”, plus the network’s paid partnership label. “#ad”, “parceria” or “link de afiliado” on their own are not enough.
Tell the truth. Talk about Bitácora with accurate and current information about its plans, prices and features. Do not promise income, results or features that do not exist, do not publish fake reviews, and do not say that you work for Bitácora or speak on its behalf.
Our brand. You may use Bitácora’s official name, logo and screenshots only to recommend it and only while you are an affiliate. Do not register domains, accounts, profiles, apps or names that contain “Bitácora” or resemble it, and do not pretend to be us.
Search ads. Do not bid on the Bitácora brand together with words about our product, on “bitacora.live” or on its variants or misspellings, and do not use our domain as the display URL of an ad. The Spanish word “bitácora” on its own, in its ordinary meaning, is not affected. Other paid ads are allowed if they follow these terms.
It is forbidden to:
- send emails, messages or comments to people who have not agreed to receive them (spam), or drop your link in bulk in forums or comments;
- publish your link on coupon, deal or cashback sites;
- pay, give back part of your commission or reward anyone to subscribe;
- use bought or automated traffic, forced cookies, hidden redirects or any trick to get accounts you did not bring attributed to you;
- use your own link, or someone else’s, to get the discount or the commission;
- promote Bitácora alongside content that is illegal, hateful, sexually explicit or misleading.
Your audience’s law. Follow the advertising and commercial influence rules of the countries you target. For example, if you target an audience in France, use “Publicité” or “Collaboration commerciale” throughout the promotion. In Brazil, that includes the Consumer Protection Code and CONAR’s guide to advertising by influencers.
Review. We may review how you recommend Bitácora and ask you to change or remove content. Do so within 5 days at most.
8. Fraud, changes and termination
- Fraud or breach. If we see signs of fraud or that you are breaching these terms, we may hold your commissions for up to 90 days while we review it, and ask Lemon Squeezy to reject the affected referrals. If confirmed, you lose the unpaid commissions arising from that practice and we may end your participation.
- Changes. We may change these terms by emailing you 30 days in advance. Changes to amounts or periods do not affect the people already attributed to you. If you do not agree, you can leave without losing what you have earned; if you stay, you accept them.
- Leaving. You can leave the program whenever you want. We may end your participation by notifying you by email.
- On termination. If you leave, or if we end your participation without you having breached these terms, we pay you what you have earned up to that day, once its 30-day wait has passed. If we end it for a breach, you lose the unpaid amounts arising from that breach. In both cases, remove your links within 10 days at most.
- If we close the program for everyone, we give 60 days’ notice and pay what has been earned up to the closing date.
9. Other terms
- Relationship. You act on your own account, as an independent professional. You are not an employee, agent or representative of Bitácora, and you cannot bind us.
- Your data. We process the data in your application and your activity as an affiliate under the Privacy Policy. Inside Bitácora you only see counts (clicks, sign-ups, paying people and commissions), never the name or email of the people you bring. Lemon Squeezy shows you in its Affiliate Hub whatever data it decides.
- Confidentiality. Do not share any of our information that is not public, such as figures or news before they are announced.
- Liability. You are responsible for your content and the claims it causes. Our liability to you is limited to what we paid you or owe you in the previous 12 months, except where the law does not allow it to be limited.
- Governing law. The law of the Bitácora Terms, without prejudice to the mandatory rules of the country where you live or that you target. If you target an audience in France and your commissions with us reach €1,000 excluding VAT in a year, these terms are the written contract required by French law on commercial influence, and French law applies to the extent that law requires.
